Terms of Service
These Terms of Service ("Terms") govern your use of maxxroofing.com (the "Site"), operated by Maxx Roofing & Construction LLC ("Maxx Roofing," "we," "us"). By using the Site, you agree to these Terms.
1. Acceptance of Terms
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.
2. Use of the Site
You agree to use the Site only for lawful purposes. You will not:
- Use the Site to transmit malware, spam, or unlawful content
- Attempt to gain unauthorized access to our servers, accounts, or data
- Use automated tools to harvest content from the Site without written permission
- Misrepresent your identity or impersonate another person
- Interfere with the Site's normal operation
3. Content You Submit & Ownership
All information, photographs, project descriptions, addresses, contact details, chat messages, calculator inputs, and any other content you submit through the Site (collectively, "Submissions") become the operational property of Maxx Roofing & Construction LLC upon submission. You grant us a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, sublicensable license to use, store, reproduce, modify, distribute, display, analyze, and create derivative works from your Submissions for any lawful business purpose, including marketing, training, lead generation, and quality improvement.
This license survives any termination of your use of the Site and is transferable to any successor entity in the event of a merger, acquisition, sale of assets, reorganization, or bankruptcy of Maxx Roofing & Construction LLC.
You represent that you own or have the right to share each Submission, and that the Submission does not violate any law or third party's rights. Your statutory privacy rights (including rights to access, correct, and delete) under applicable law remain unaffected — see our Privacy Policy.
4. Estimates & Roof Measurement Tools
The roof measurement tool, financing calculator, and shingle visualizer are illustrative tools, not binding quotes or contracts. Square footage estimates, cost ranges, monthly payment figures, and shingle preview images are approximations only. Actual project pricing and scope are determined by an in-person inspection and a written estimate signed by both parties. Maxx Roofing makes no representation or warranty that the tools' outputs will match your final project cost or appearance.
5. Financing Calculator Disclaimer
The financing calculator is provided for informational purposes only. It does not constitute an offer of credit, a loan commitment, or a guarantee of approval. Actual loan terms, rates, fees, and approval are determined by independent third-party lenders subject to credit review. Maxx Roofing is not a lender and is not liable for the terms of any financing you obtain.
6. Phone & SMS Consent
By providing your phone number through any form on the Site or by clicking a "Text us" or "SMS" link, you consent to receive calls, voicemails, and text messages from Maxx Roofing & Construction LLC at that number, including auto-dialed and pre-recorded messages, regarding your project, scheduling, follow-ups, and our roofing services. Consent is not a condition of any purchase. Message and data rates may apply. You can opt out of marketing texts at any time by replying STOP. To opt out of all communications, email [email protected].
7. Warranties & Disclaimers
Roofing services performed by Maxx Roofing carry the manufacturer's material warranty (e.g., GAF, Owens Corning, CertainTeed) plus our written workmanship warranty as specified in your signed contract. The Site itself is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the maximum extent permitted by law, Maxx Roofing & Construction LLC, its officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site, even if we have been advised of the possibility of such damages. Our total aggregate liability arising from or relating to the Site shall not exceed one hundred U.S. dollars ($100), exclusive of liability under your signed roofing services contract, which is governed separately by that contract.
9. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict-of-law principles. Any dispute arising from or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Tulsa County, Oklahoma, and you consent to personal jurisdiction in those courts. The parties waive the right to a jury trial. Disputes related to a signed roofing services contract are governed by the dispute-resolution provisions of that contract.
10. Indemnification
You agree to indemnify and hold harmless Maxx Roofing & Construction LLC and its officers, employees, and agents from any claim, loss, liability, damages, or expense (including reasonable attorneys' fees) arising from your misuse of the Site, your Submissions, or your violation of these Terms.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including suspected violation of these Terms. Sections 3 (Submitted Content), 7–10, and 12 survive termination.
12. Changes
We may update these Terms from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the updated Terms.
